The Universal 5 Steps EOT Assessment Tree
I came across this table by Dr. Hendrik Pinsloo PHD and it is very simple, to the point and self explanatory.
I actually find it very useful as it is Universal and can be applied to most standard form of contracts.
Readers who are using FIDIC 2017 Red Book should take special note of Step 1 as Sub Clause 20.2 which is the compliance Clause consists of 2 time bars.
The 1st compliance requirement is the serving of the Notice of Claim under Sub Clause 20.2.1
The 2nd time bar is the submission of a fully detailed claim, the most important component of which is Sub Clause 20.2.4 (b) which require a statement of the contractual and/or other legal basis of the claim. Failure to comply with the 1st or 2nd time bar will invalidate the Contractor’s Claim for time and cost.
