What is an Essential But Seldom Carried Out 1st Step that Most Contract Administrator fail to do when the Contractor is awarded a Construction Contract ?

CONTRACT ADMINISTRATION TIP : NO 1 — Reformatting the Conditions of Contract for Easier Reading & Reference

The majority of Construction Contracts are based on Industry Standard Forms like FIDIC, NEC, ICE etc etc. However, it is seldom that the standard clauses are left alone unamended for use. FIDIC forms users normally amend the contract terms and conditions through an annexure known as “Particulars Conditions of Contract” or PCC in short.

In my years in handling Construction Disputes and Claims, I have, time and time again refer to the 2 documents — the Main Conditions and the Particular Conditions for reference. It is a very difficult and tedious process trying to read them together as one when they are fragmented into 2 separate documents. Flicking between two documents to attempt to work out the real wording of the amended clause is a real pain and not conducive to making it clear as to what has been agreed.

As such I sometime wonder why a simple task of integrating/merging the two documents into one for ease of reading/understanding is seldom done. Why ?

I have no answer. Perhaps it never occurred to the Contract Administrator to do so. Hope that my above working tip is adopted as the 1st essential step whenever a Contract is awarded.

A simple method to merge amendment clauses is as follows:

Copy paste the original clause in black font.
Change the deleted text to red font and strike through
Add the amended text in dark blue font.
You can now read the whole amendment in one flow of text and the anomalies jump out.

Extract — Amendments made are in red with any deletion striked out.
